Terms of Use

2.1 Acceptance

By accessing and using the Platform, you acknowledge that you have read, understood and accepted these Terms in their entirety.

Registration on the Platform constitutes express acceptance of these Terms.

2.2 Legal Capacity

You declare that you are of legal age and have the legal capacity to contract. If you use the Platform on behalf of a legal entity, you declare that you have the necessary powers to bind it.

2.3 Modifications to Terms

Traject reserves the right to modify these Terms at any time. Modifications will take effect 30 days after notification to Users by email or via the Platform.

Continued use of the Platform after the modifications take effect constitutes acceptance of the new Terms.

Traject is a SaaS platform that supports freelancers and employees in managing their professional careers through five main pillars:

• Manage your career: tools for defining vision, objectives, roadmap and tracking
• Position yourself in the market: analysis of growing sectors and expertise value
• Build your skills: resources to develop knowledge and skills
• Sell your profile: tools to build your story, pitch and manage prospecting
• Manage your finances (freelance): business plan, tax optimization and cash flow tools

4.1 Registration

Access to certain features of the Platform requires creating a user account. When registering, you agree to:

• Provide accurate, current and complete information
• Maintain and update this information to keep it accurate
• Create only one account per person
• Not impersonate another person or entity

4.2 Login Credentials

When creating your account, you set login credentials (email and password). You are solely responsible for:

• The confidentiality of your credentials
• All activities carried out on your account
• Immediately informing Traject in case of unauthorized use

You agree not to share your credentials with third parties. Account sharing is strictly prohibited.

4.3 Account Security

You agree to use a strong and unique password. We recommend enabling two-factor authentication when available.

4.4 Account Suspension and Termination

Traject reserves the right to suspend or terminate your account in case of:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscribed services
• Prolonged inactivity (more than 24 months)

5.1 User Commitments

You agree to use the Platform legally, ethically and in accordance with these Terms. It is specifically prohibited to:

• Use the Platform for illegal or unauthorized purposes
• Infringe the intellectual property rights of Traject or third parties
• Attempt unauthorized access to Traject systems
• Use scraping, crawling or automated data extraction techniques
• Transmit viruses, malware or any malicious code
• Harass, threaten or defame other users
• Publish illegal, offensive, discriminatory or inappropriate content
• Use the Platform to send spam or unsolicited communications
• Bypass security measures or access restrictions
• Create fake accounts or use bots
• Resell or redistribute access to the Platform without authorization

5.2 Professional Use

The Platform is intended for professional use for career management. You agree to use it within this framework only.

5.3 Abuse Reporting

6.1 Content Responsibility

You are solely responsible for content you create, share or store on the Platform (hereinafter "User Content"). You warrant that your User Content:

• Does not violate any applicable law or regulation
• Does not infringe the rights of third parties (intellectual property, privacy, etc.)
• Is accurate and not misleading
• Does not contain viruses or malicious code

6.2 License Granted to Traject

By posting User Content, you grant Traject a worldwide, non-exclusive, royalty-free and transferable license to use, reproduce, adapt and display this content as part of providing the services.

This license ends when you delete your User Content or your account, subject to a reasonable technical delay.

6.3 Moderation

Traject reserves the right, without obligation, to moderate, delete or refuse any User Content that violates these Terms or is deemed inappropriate.

6.4 Backup

You are responsible for maintaining your own backups of your User Content. Traject cannot be held responsible for data loss.

7.1 Traject Property

All elements of the Platform (structure, design, texts, graphics, software, databases, sounds, videos, photographs, trademarks, logos, etc.) are the exclusive property of AIGENZ or are used under license.

Any reproduction, representation, modification, publication, adaptation of all or part of the Platform, by any process whatsoever, is prohibited without prior written authorization from AIGENZ.

7.2 License of Use

Subject to compliance with these Terms, Traject grants you a personal, non-exclusive, non-transferable and revocable license to access and use the Platform.

This license does not grant you any ownership rights to the Platform or its content.

7.3 Trademarks

"Traject" and all associated logos are registered or pending trademarks of AIGENZ. Any unauthorized use of these trademarks is strictly prohibited.

8.1 Availability

Traject strives to maintain the Platform accessible 24/7. However, Traject cannot guarantee uninterrupted and error-free operation of the Platform.

8.2 Maintenance

Traject reserves the right to perform maintenance, updates or improvements to the Platform. These operations may cause temporary interruptions.

Where possible, scheduled maintenance will be performed outside business hours and announced in advance.

8.3 Force Majeure

Traject cannot be held responsible in case of inability to provide services due to force majeure as defined by French case law.

Personal data collected and processed in connection with the use of the Platform is handled in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

10.1 Nature of Services

The Platform provides tools and resources to help with career management. Traject does not provide personalized legal, tax or financial advice.

The information provided is for informational purposes only and should not substitute advice from qualified professionals.

10.2 Limitation of Liability

To the extent permitted by law, Traject cannot be held liable for:

• Decisions made by the User based on information or tools provided by the Platform
• Indirect damages such as loss of profits, data, customers or business harm
• Temporary inability to access the Platform
• Data loss resulting from User action
• Viruses or other harmful elements that may infect User equipment

10.3 Cap

In any event, Traject's liability shall not exceed the amounts paid by the User for their subscription for the last 12 months.

10.4 Service Provided "As Is"

The Platform is provided "as is" and "as available". Traject does not guarantee that the Platform will be error-free or that defects will be corrected.

The Platform may contain links to third-party sites. These links are provided for informational purposes only. Traject has no control over these sites and disclaims all responsibility for their content.

12.1 Termination by User

You can delete your account at any time from your profile settings or by contacting support.

12.2 Termination by Traject

Traject may terminate your access to the Platform in case of violation of these Terms, with or without notice depending on the severity of the violation.

12.3 Effects of Termination

Upon termination, your access to the Platform will be immediately suspended. Your data will be retained in accordance with our Privacy Policy and then deleted.

These Terms are governed by French law.

In case of dispute relating to the interpretation or execution of these Terms, the parties will endeavor to resolve it amicably.

Failing amicable agreement, the dispute will be submitted to the competent courts of Paris, subject to mandatory contrary provisions.

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Traject regarding use of the Platform.

14.2 Partial Nullity

If any provision of these Terms is declared null or unenforceable, the other provisions shall remain in force.

14.3 Waiver

Failure by Traject to exercise a right under these Terms does not constitute a waiver of that right.

14.4 Assignment

You may not assign your rights and obligations under these Terms without prior written consent from Traject.
